If you hold a temporary residence card marked “employee” and its expiry date is approaching, the practical question is straightforward: which documents should you prepare to renew your status safely? This guide explains the main documents, deadlines and issues that can affect a renewal application.
Who is concerned by renewal of an employee residence permit?
The temporary residence card marked “employee” is issued to foreign nationals carrying out salaried employment under the conditions laid down by Article L. 421-1 of the CESEDA. It is linked to the underlying employment and, where required, a valid work authorisation.
Renewal is therefore relevant where the employee intends to continue working and residing lawfully in France after the current permit expires.
When should the renewal application be filed?
The filing period depends on the procedure used.
ANEF applications
Where the relevant category is handled through ANEF, the ordinary renewal window is generally between the 120th and 60th day before expiry, in other words around four to two months before the residence document expires.
Procedures outside ANEF
Where the category is not processed through the online service, the application is generally filed during the two months preceding expiry, subject to the local procedure and the legal rules applying to the status.
What happens if the application is late?
Late filing can result in additional charges and, more importantly, can create a gap in documentary protection. In some cases, an application made long after expiry may require the applicant to demonstrate again that the legal entry and residence conditions are satisfied.
Documents normally required for renewal
Identity and civil-status documents
- A valid passport, including the relevant identity, visa and entry-stamp pages.
- The current residence permit.
- Where requested, a birth certificate and any required certified translation or legalisation.
Proof of address
Provide recent evidence of residence in France, such as utility bills, a tenancy agreement or, if staying with another person, a hosting statement together with the host's identity document and proof of address.
Identity photographs
Provide recent compliant photographs or the digital photo/signature code required for an online application.
Employment documents
The employment evidence is central to the renewal application. Useful documents normally include:
- the current employment contract;
- recent payslips;
- an employer certificate confirming that the employment continues;
- where relevant, documents relating to the end of a previous employment;
- the work authorisation applicable to the current role where a separate authorisation is required.
Work authorisation
Where the residence status is linked to a specific authorised employment, a change of employer or substantial change in the role may require a fresh work authorisation. This should be checked before renewal rather than discovered after the prefecture raises the issue.
What if you lose your job involuntarily?
The CESEDA contains important safeguards for foreign employees who are involuntarily deprived of employment. The precise consequences depend on the status held, the circumstances of the termination and any unemployment-insurance entitlement.
Useful supporting documents can include:
- the dismissal letter or approved termination agreement;
- France Travail registration;
- evidence of unemployment-benefit entitlement;
- proof of active job search.
Do not assume that unemployment automatically ends the right to reside. The legal consequences should be checked against the status held.
Moving from a temporary employee permit to a multi-year permit
After an initial period of lawful residence, an employee may qualify for a multi-year residence permit if the conditions of Article L. 433-4 and the relevant integration rules are satisfied.
Republican Integration Contract
Where the applicant falls within the ordinary integration pathway, they may need to show serious participation in the Republican Integration Contract and completion of the required civic and language steps.
Civic examination
Under the current regime, successful completion of the civic requirement may be necessary for access to a multi-year permit.
French-language level
The ordinary multi-year permit is subject to the French-language level required by the legislation in force at the date of the application, generally around A2 under the current regime, subject to exemptions.
Continued compliance with the original status
The applicant must continue to satisfy the conditions attached to employee status, including lawful employment and any required work authorisation.
Temporary documents while the renewal is being examined
Récépissé
For procedures handled directly by the prefecture outside ANEF, a renewal récépissé may provide temporary evidence of lawful residence and, depending on the permit renewed, permission to work.
ANEF extension certificate
For online renewals, the initial submission acknowledgement is not the same as proof of lawful residence. If the application remains pending when the existing permit expires, an attestation de prolongation d'instruction may preserve lawful residence and work rights where the legal conditions are met.
Expired documents in certain cases
Article L. 433-3 provides a limited safeguard for certain long-duration residence documents, allowing the expired document to evidence lawful residence for a defined period while renewal is pending. The scope of that rule should be checked against the exact permit held.
Habitual residence for renewal of a multi-year permit
Renewal of certain multi-year residence permits requires evidence of habitual residence in France. The CESEDA defines this by reference to the centre of the person's private and family interests and a minimum period of physical presence in France during the relevant years.
Bank activity, payslips, tax assessments, accommodation evidence and other documents can help establish effective residence.
Common reasons for refusal
Employment no longer satisfies the permit conditions
If the applicant no longer holds qualifying employment and does not benefit from the statutory protection for involuntary unemployment, renewal may be refused.
No valid work authorisation
A change of employer without the required new authorisation can jeopardise renewal.
Public-order grounds
The prefecture may refuse renewal where the applicant's presence represents a public-order threat under the applicable legal test.
Failure to meet integration requirements
For progression to a multi-year permit, failure to satisfy the applicable civic or language requirements may prevent the grant of that longer status.
Incomplete application
Missing or inconsistent documents can delay the application and may ultimately lead to refusal if requested evidence is not provided.
What can you do if renewal is refused?
Administrative reconsideration
A request for reconsideration may be made to the prefect, supported by any new evidence capable of addressing the reasons for refusal.
Hierarchical appeal
A hierarchical appeal to the Minister of the Interior may also be available in an ordinary residence-refusal case.
Proceedings before the administrative court
A simple refusal is generally challenged within two months of notification. Where the refusal is accompanied by an OQTF, the shorter OQTF deadlines apply: ordinarily one month, seven days under house arrest and forty-eight hours in administrative detention.
Only a timely court challenge under the applicable OQTF procedure suspends forced removal.
Checklist for renewal
Identity: passport, current residence permit, and any required civil-status document.
Address: recent proof of residence or hosting evidence.
Employment: current employment contract, recent payslips and employer certificate.
Work authorisation: evidence of the authorisation covering the current employment where required.
Involuntary unemployment: termination documents, France Travail registration and benefit evidence.
Multi-year permit: integration, civic and language evidence required under the rules in force.
Photographs: compliant identity photographs or digital photo code.
Why obtain legal assistance?
Renewal can become complex where there has been a change of employer, unemployment, a long absence from France, problems with work authorisation or difficulty meeting the conditions for a multi-year card.
A lawyer can review the application before filing, identify weak points and respond quickly if the prefecture refuses renewal.
