Renewing a residence permit as the spouse of a French national: complete guide

Auteur : Maître FAZOLO
Temps de lecture : 4 minutes

The foreign spouse of a French national benefits from a specific residence regime, but renewal of the permit remains subject to precise conditions. An incomplete application or a misunderstanding of the applicable rules can lead to refusal and, in some cases, an irregular immigration position. This guide explains the main conditions, documents and procedural steps.

Conditions for renewal

Continuity of married life

This is the central requirement. The administration checks that the spouses genuinely continue to live together on the date of the renewal application. A breakdown in the shared life may lead to refusal.

There are important exceptions, particularly where the foreign spouse has experienced domestic violence. In those circumstances, renewal may remain possible despite separation, provided the situation is properly evidenced through documents such as police reports, protection orders, medical evidence or statements from specialist organisations.

The genuine nature of the marriage

The administration may verify that the marriage was not entered into solely for immigration purposes. More recent marriages can attract closer scrutiny and requests for additional evidence.

Republican integration

For progression to certain longer-term residence statuses, the foreign spouse must satisfy the integration requirements applicable at the time of the application. Depending on the permit sought, this may include evidence of French-language proficiency, civic knowledge and participation in the Republican Integration Contract.

The precise language level and supporting evidence depend on the status being requested. Applicants should check the current rules for their category before filing.

Documents to prepare

Civil-status and marriage documents

  • A recent marriage certificate. Where the marriage took place abroad, prior registration in the French civil-status records will generally be required.
  • A valid passport for the applicant, including the relevant visa and entry-stamp pages.
  • A valid French identity card or passport for the French spouse.
  • Where relevant, civil-status documents relating to the couple's children.

Evidence of shared life and address

The prefecture expects concrete evidence of cohabitation. Useful documents include:

  • a tenancy agreement in both names or joint proof of ownership;
  • joint tax documents;
  • health-insurance or CAF documents;
  • recent utility, telephone or internet bills;
  • bank statements showing the same address;
  • official correspondence addressed to both spouses at the same address.

Where the couple has children together, school and medical records may also provide useful evidence of family life.

Evidence of financial circumstances

The documents will depend on the household's professional situation. These may include payslips, an employment contract or employer certificate, tax declarations for self-employed applicants, or evidence of the French spouse's income where relevant.

Photographs and application documents

  • Recent compliant identity photographs.
  • The documents required by the ANEF procedure or competent prefecture.
  • Payment of any applicable tax when requested.

Submitting the renewal application

When should the application be filed?

For applications made through ANEF, the renewal window generally opens between four and two months before expiry of the current permit, subject to the rules applying to the particular category.

After the required period of marriage and lawful residence, some spouses of French nationals may qualify for a ten-year resident card, subject to the statutory conditions in force, including the applicable civic and language requirements.

Processing times

Renewal applications can take several months to process. If the administration requests additional evidence, respond within the stated period to avoid unnecessary delay or adverse consequences.

If renewal is refused

A refusal can be challenged. The appropriate route depends on whether the decision is a simple residence refusal or is accompanied by an OQTF.

Administrative reconsideration

A request for reconsideration may be addressed to the prefect who made the decision, particularly where new evidence is available or there appears to have been an error. However, applicants should not assume that such a request preserves every court deadline, especially where an OQTF is involved.

Proceedings before the administrative court

A simple residence refusal is generally challenged within two months of notification. Where the refusal is accompanied by an OQTF, shorter deadlines apply: ordinarily one month, seven days in cases of house arrest and forty-eight hours in administrative detention. The notification must be checked immediately.

Specialist legal advice is strongly recommended where an OQTF or urgent procedural issue is involved.

Submitting a fresh application

Where refusal results from an incomplete file or missing evidence and the underlying circumstances can be regularised, a new application may sometimes be appropriate. This does not automatically replace or suspend an existing appeal deadline.

Frequently asked questions

When should I renew my permit?

For ANEF renewals, the filing window is generally between four and two months before expiry. Check the precise timetable applicable to your status.

What if my French spouse and I no longer live together?

A breakdown in shared life can affect renewal, but important exceptions exist, particularly in cases involving domestic violence. Other residence routes may also become relevant depending on family circumstances.

Is a marriage celebrated abroad recognised?

For residence procedures based on marriage to a French national, a marriage celebrated abroad generally needs to be registered in the French civil-status records before it can be relied upon fully against the administration.

Why seek legal advice?

Renewal affects the right to live and work in France and may have significant consequences for family life. Careful preparation helps reduce the risk of refusal and ensures that any appeal deadline is protected.
