French visa refused: what appeal is available?

A French short-stay or long-stay visa application may be refused for a range of reasons, including insufficient documents, doubts about the purpose of the stay, immigration history, public-order concerns or insufficient resources.

The refusal should state the reasons and inform the applicant of the available appeal route.

How is a French visa refusal challenged?

The process normally involves two stages:

  1. a mandatory prior administrative appeal;
  2. if that appeal is rejected, proceedings before the Administrative Court of Nantes.

Mandatory prior administrative appeal

For a short-stay visa refusal, the appeal is made to the competent visa authority within the Ministry of the Interior.

For a long-stay visa refusal, the appeal is made to the Commission de recours contre les décisions de refus de visa d'entrée en France (CRRV).

The prior appeal must generally be submitted within 30 days of notification of the refusal. It should be drafted in French and address the factual and legal reasons given by the consulate.

A strong appeal does more than repeat the original application. It should respond directly to the stated ground of refusal and provide any evidence capable of correcting the consulate's assessment.

Proceedings before the Administrative Court of Nantes

If the mandatory administrative appeal is rejected, the applicant can bring an annulment application before the Administrative Court of Nantes, which has specialised jurisdiction for French visa-refusal litigation.

The ordinary court deadline is generally two months from notification of an express rejection or from the date on which an implied rejection arises after administrative silence.

Urgent interim remedies

Where there is genuine urgency, the applicant may consider:

  • référé-suspension, requiring urgency and a serious argument capable of casting doubt on the lawfulness of the refusal;
  • référé-liberté, reserved for exceptionally serious and manifestly unlawful interference with a fundamental freedom.

French administrative case law recognises that urgent interim relief can, in appropriate circumstances, be sought even while the mandatory prior administrative appeal is pending, provided the applicant has actually lodged that appeal.

How should the appeal be prepared?

  • Keep the full refusal notice and proof of notification.
  • Identify the exact reason code or reasoning used by the consulate.
  • Provide documents answering that reason directly.
  • Explain the genuine purpose of travel or residence clearly.
  • Where relevant, demonstrate family ties, professional circumstances, financial resources and intention to comply with visa conditions.
