ANEF extension certificate not received: rights and next steps

When a foreign national submits a residence-permit renewal through ANEF, the platform first provides a submission acknowledgement. If the administration has not decided the renewal by the time the current residence document expires, an attestation de prolongation d'instruction may be required to preserve lawful residence and, in a renewal case, the rights attached to the previous permit.

Not receiving this certificate can create immediate difficulties with employment, social rights and everyday procedures. It is therefore important to react quickly and to understand which remedies are available.

What is an extension certificate?

A document linked to a pending ANEF application

The certificate is issued where the relevant statutory conditions are met and the online residence application is still being examined after expiry of the previous residence document.

Its legal function

The certificate can:

  • show that the residence application remains under examination;
  • evidence lawful temporary residence during that period;
  • in a renewal case, preserve the right to work where the previous permit authorised employment.

The applicant must have complied with the filing requirements applicable to the renewal, including the relevant filing window.

What are the risks if no certificate is issued?

The absence of a valid temporary document can make it difficult to prove lawful residence or work rights, even where the applicant did everything required. Employers, banks and public bodies may refuse to act without documentary evidence.

In the most serious cases, the person may also face an adverse immigration decision. Any OQTF must be reviewed against the actual legal position at the date it was made.

What should you do?

1. Contact ANEF and the prefecture immediately

Use the available support channels, retain screenshots and written records and ask the prefecture to confirm the status of the application and issue the appropriate temporary document.

2. Send a formal written request

If ordinary follow-up does not work, send a reasoned letter identifying the application, the expiry date, the absence of a certificate and the practical consequences. Use a method that provides proof of delivery.

If the applicable period of administrative silence has already created an implied refusal, the strategy may need to shift from requesting a certificate to challenging that refusal and, where appropriate, requesting its reasons.

3. Obtain specialist legal advice

Where employment, social rights or lawful residence are at immediate risk, legal advice can help identify whether urgent court proceedings are appropriate.

Possible court remedies

Depending on the procedural position, several remedies may be relevant:

  • référé mesures utiles under Article L. 521-3 of the Code of Administrative Justice, where no conflicting administrative decision has yet arisen and an urgent useful measure is sought;
  • référé-suspension under Article L. 521-1, together with main proceedings against an adverse decision where the statutory conditions are met;
  • référé-liberté under Article L. 521-2 in exceptional cases involving a serious and manifestly unlawful interference with a fundamental freedom;
  • ordinary judicial review of an express or implied refusal.

What if an OQTF has been issued?

An OQTF must be challenged within its own strict deadline. The appeal timetable is generally one month in the ordinary case, seven days under house arrest and forty-eight hours in administrative detention. Do not wait for the certificate issue to be resolved before protecting the OQTF deadline.

Frequently asked questions

Must the administration issue an extension certificate?

Where the statutory conditions for a timely pending renewal are satisfied and the previous permit expires before the application is decided, the administration must provide the temporary documentary protection required by the CESEDA. The precise document depends on the procedure.

Can I work without the certificate?

Do not assume that an ANEF submission acknowledgement is sufficient. The right to work depends on the legal status and the valid temporary document. Employers should check the precise evidence before allowing work to continue.

How long can processing take?

There is no single processing period for every residence category. In many applications, however, administrative silence after the applicable statutory period creates an implied refusal. That date must be monitored carefully.

What if I receive an OQTF while waiting for the certificate?

Protect the OQTF appeal deadline immediately and provide evidence that the residence application was timely and still pending. Specialist advice is strongly recommended.

Conclusion

Failure to receive an extension certificate is not a situation that should simply be tolerated indefinitely. The applicant should document the problem, contact the administration promptly and use urgent court remedies where necessary.
